Terms and conditions of sale
Effective as of [à compléter : date de mise en ligne].
1. Seller
The products on this website are sold by Mister Pool, [à compléter : forme juridique et capital social], 87 Rue de Sandy Ground, 97150 Baie Nettlé, Saint-Martin, SIRET [à compléter : SIRET], [à compléter : RCS]. Phone: +590 690 37 88 45. Email: info@mister-pool.fr.
2. Scope
These terms apply to every order placed on this website by a consumer or a business customer. Placing an order means accepting the terms in force on the day of the order. Saint-Martin is a French overseas collectivity, so sales are governed by French law.
3. Products
Products are described as accurately as possible on their product page. Water treatment products are chemicals: read the label and the manufacturer's instructions before use, and store them dry, away from heat and out of the reach of children. If you are unsure which product to choose, contact us before ordering.
4. Prices
Prices are shown in US dollars on the English version of the website and in euros on the French and Dutch versions. They include all applicable taxes and exclude delivery charges. Delivery charges are shown before you confirm your order. You pay the price displayed at the time of ordering.
5. Orders
You choose your products, check your cart, enter your details and delivery method, then confirm and pay. A confirmation email summarises your order. Mister Pool may refuse or cancel an order in the event of a previous dispute, suspected fraud or an unavailable product; any amount paid is then refunded.
6. Payment
Payment is made online by card through a secure payment platform. Mister Pool never has access to your full card details. Orders are processed once payment is confirmed.
7. Delivery and collection
The available delivery methods, their charges and lead times are shown when you order. For shipments to neighbouring islands (Anguilla, Antigua, Saba), the delivery terms and departure days from Galisbay port are set out in our privacy policy and delivery terms; sea freight and customs charges on arrival are paid by the customer. When you receive your parcel, check its condition and report any damage to the carrier and to Mister Pool without delay.
8. Right of withdrawal
Consumers have 14 days from receipt of the products to withdraw from the purchase without giving a reason (articles L221-18 and following of the French Consumer Code). Tell us by email at info@mister-pool.fr, then return the products within the following 14 days; return costs are paid by the customer. We refund you within 14 days of receiving your decision, and may wait until the products are back with us. This right does not apply, in particular, to goods unsealed after delivery that cannot be returned for hygiene or health protection reasons, or to goods made to the customer's specifications (article L221-28). The return procedure is detailed in our refund and returns policy.
9. Legal guarantees
Products are covered by the legal guarantee of conformity (articles L217-3 and following of the French Consumer Code) for two years from delivery, and by the guarantee against hidden defects (articles 1641 and following of the French Civil Code). To use it, contact us with your order number and a description of the problem, with photos.
10. Liability
Mister Pool is not liable for damage resulting from use of the products contrary to the manufacturer's instructions, or for delays or failures caused by force majeure, such as a hurricane, a port closure or an interruption of sea links.
11. Personal data
The data collected with your order is used to process it and to look after you as a customer. How it is handled is explained in our privacy policy.
12. Complaints, mediation and disputes
Any complaint can be sent to info@mister-pool.fr. If no amicable solution is found, consumers can refer the matter free of charge to the following consumer mediator: [à compléter : médiateur de la consommation]. These terms are governed by French law; failing an amicable agreement, the competent French courts will have jurisdiction.
